WORLD COURT REFUSES TO IDENTIFY REAGAN AND GORBACHEV AS WAR CRIMINALS REJECTS WORLD CITIZEN GARRY DAVIS' PETITION ON TECHNICAL GROUNDS

NEW YORK, NY....Garry Davis, founder of the World Government of World Citizens, who, on March 15, 1985, petitioned the International Court of Justice at The Hague to find President Reagan (USA) and Mikhail Gorbachev (USSR) guilty of threatening OMNICIDE through nuclear extinction, was denied the right to be heard since he is an individual and not a nation-state. Yet death through nuclear holocaust, he claimed in his petition, threatened by the very nation-states which founded the Court, faces all citizens on this globe

If, under the Nuremberg Principles, individuals are responsible for war and its preparation, his petition asserted, then individuals must have the right to charge other individuals for those crimes.

In a press conference today held across the street from the United Nations, Davis said that "I have now exhausted all the legal remedies on planet earth. In the absence of any further court process available to me, therefore, I now have no legal alternative but to exercise my personal sovereignty as a threatened human being.

Therefore in my own name and that of my threatened humanity, I
a. enjoin the two respondents, Presidents Reagan and Gorbachev, to comply with items #4 and #5 of my petition, i.e., stop the arms race and implement article 28 of the Universal Declaration of Human Rights*; but
b. should they fail to do so, I will make a 'world citizen arrest' on November 19, 1985 when they meet together in Geneva charging them as war criminals in accordance with the Nuremberg Decisions and international law."

"You can't try omnicide after the fact," he added

A former World War II bomber pilot, Davis has been trying for almost 40 years to legitimize his claim to world citizenship. His petitions have been rejected in the U.S. by the Supreme Court.

Calling the World Court impotent to deal with the question of war itself, Davis concluded that, "The world, faced with nuclear holocaust, cannot afford this legal duplicity any more when missiles are loaded with nuclear warheads throughout Europe and Russia, the U.S. is on a nuclear alert 24 hours per day, and there is a 15 minute lead time from launch to target in both directions."

The World Citizen's new approach, explained to the United Nations' Special Assistant to the Under-Secretary-General for Disarmament Affairs, Prvoslav Davinic-who had requested information regarding the Court's ruling to Davis' petition-would take the form of a World Court of Human Rights as the judicial arm of the World Government of World Citizens, throwing out the legal mumbo-jumbo used in international agreements and basing itself on the Universal Declaration of Human Rights. The individual would have the right to appeal to this Court for redress of international grievances.

"When the individual has exhausted all external legal remedies," Davis added in his letter to Davinic, "then the law and sovereignty revert to him. If a red traffic light is stuck, after looking left and right and ascertaining that the way is clear, one drives through."

"The citizens of the world must have their own political representation now," Davis concluded today. "I call, therefore, for a worldwide coalition of peace forces, individuals and groups, to unite under the banner of a new political party, the World Citizen party, with a platform of one world and one humanity under just world law, already sanctioned by article 21(3) of the Universal Declaration of Human Rights.**"
